These terms cover your use of bidwinbuild.com and your purchase and use of BidWinBuild products. By using the site or buying a product, you agree to them. Our Privacy Policy explains how we handle your information.
1. Who we are
BidWinBuild ("BidWinBuild," "we," "us") is based in Altamonte Springs, Florida. We sell Excel-based estimating and project-management tools to commercial general contractors.
2. Buying a product
Products are sold through Gumroad. Gumroad handles checkout, payment, sales tax, and receipts under its own terms. When payment clears, you can download your file immediately, and you also receive it by email. Prices are shown at checkout and can change at any time, but a change never affects a purchase you've already made.
3. Your license
When you buy a product, you receive a perpetual, non-exclusive license to use it for your own business, with no subscription, no account, no per-seat fees, and no activation limits. You may install it on your company's computers and share it with your own employees and contractors who work for you.
You may not resell, redistribute, sublicense, or publish the file or its contents, including as a template or as part of a competing product, and you may not share it with people or companies outside your organization. BidWinBuild keeps all ownership of the products and the intellectual property in them. You are free to enter your own data and customize the file for your own use.
4. Updates
Every purchase includes one year of free updates from the date of purchase. Nothing stops working when the year ends. You simply stop receiving new updates unless we offer them again.
5. Refunds
Because products are delivered instantly as digital files, all sales are final. That is why we offer a free calculator, so you can try the build quality before you buy. The exceptions are the ones the law requires, and a file that is corrupted or won't open: in that case, contact us and we will fix it or replace it.
If you have a problem with an order, please email us before opening a payment dispute, and we will work to resolve it.
6. Free tools
Free tools, such as the Margin vs. Markup Calculator, are provided as is. The calculator runs in your browser and does not send the numbers you enter to us.
7. Estimating tools are aids, not advice
Our products help organize and calculate estimates, but you are responsible for checking every quantity, price, formula, and assumption before you rely on it in a bid or contract. We do not guarantee that using our tools will win work, produce any particular margin, or be free of errors. Nothing we provide is legal, accounting, engineering, or tax advice.
8. Custom work
Custom branding, setup calls, and other custom work are provided under the quote we send you. If a quote and these terms conflict, the quote controls for that work.
9. Website use
Please don't use the site to break the law, interfere with its operation, scrape it in a way that burdens it, or try to access areas you aren't authorized to use. Site content, including text, design, and branding, belongs to BidWinBuild.
10. Trademarks
CSI and MasterFormat are trademarks of their respective owners. BidWinBuild is not affiliated with or endorsed by the Construction Specifications Institute. References to MasterFormat divisions on this site are for educational and compatibility purposes.
11. Disclaimers
The site and products are provided "as is," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law. Compatibility can vary between Excel, Google Sheets, and Apple Numbers, and we do not guarantee that every feature works in every program.
12. Limitation of liability
To the fullest extent permitted by law, BidWinBuild is not liable for indirect, incidental, special, consequential, or lost-profit damages, including losses from bids, contracts, or projects. Our total liability for any claim relating to a product is limited to the amount you paid for that product.
13. Governing law
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Florida.
14. Changes
We may update these terms from time to time. The version posted here, with its effective date, applies to your use of the site, and the version in effect at the time of purchase applies to that purchase.
